| Query: First of
all I would like to wish you all a Very Happy New
Year ! Update on Vedanta There are 2 contractors
finalized for Vedanta and they have started the
work at site. Skyline is catering to ABCD towers
and Topline to other towers. The beams for Sample
Flat and Office have been completed and end of
February you can go to site and see the Sample
Flat. Regarding construction the excavation work
is on full swing and would be completed in another
15 days. After which they would start with the
construction. There is a material improvement in
status of the project but its too early to say if
the work is on time. I would request each one of
you to kindly keep up the pressure with Raheja and
ensure they deliver. I spoke to the Customer
Service people and they have confirmed that they
would be raising demand in Jan. Thanks I hope this

since we last represented the case and we got an
assurance, inspite of time linked plan no demands
were raised so far. I also have some more details

frequently following up the matter with the
company. as much as i know legally the case has
not much merit. time linked plans are a part of
industry and followed by even reputed ones like
dlf, unitech, erose where development may not
happen corresponding to payments. committed
possession time is what should be concern and even
for that penalty clause is there. cancellation is
not an option. a social pressure is only the
option. and presently developer is in severe
pressure to be accountable and show performance.
PS - as far as representing the issue, i have
never differentiated between those booked through
me or those not booked through me. If there is a
cause or an issue we represent it and believe in
dialogue process. Anything in particular you
expect us to do. | |

| Query: I have
been to the site recently . Update is that they
have started constructing the sample flat which
should be ready by January end. Boundary wall is
almost complete in all blocks. They have recently
ordered for dewatering machines so that after
dewatering the excavation work which has been held
for months togather can be started. Also they have
finalized a conractor by the name Topline
constructions who is supposed to start the
construction work. As per Senior project manager
of Rahejaas ( Mr. Roy) they have signed up with
this contractor for delivery of flats within 2010.
Lets hope things go smooth from now on. |

Jitender, pls refer to your last reply regarding
Raheja payment plan. I agree with you. However,
whatever payment plan raheja says, but this is not
justified and is illegal to keep on demanding
money and doing nothing on the site. The pictures
you have posted on related with Rajejas project
shows no progress. it is pathatic to see just
heaps of mud across all projects knowing that they
have min 50% collection from all customers. What
ever they put in agreement doesnt become law.
Therefore i see possiblity to take action such as
RTI etc. They must tell us what are they doing
with the money, if they are not prompt on project
progress then they have no right to be very active
on charging interest. Thanks |
| Reply: sir if
you talk in legal terms, you have to be logical.
If you have signed an agreement, it is assumed
acceptance of terms and becomes binding. Between
the time linked plan you cannot question the
progress, but only for ths possession again where
at max penalty clause becomes enforceable. Same
way i doubt RTI is applicable for private
developer directly. I am not an advocate, but if
your plan is going legal, istead of arguing with
me, consult an advocate.

been reported that legal notice has been served by
a investor to Rahejas. The response of GM
Marketing is very interesting and says The
installment payment plans for all our projects are
very much construction linked in nature. The
application forms as well as agreement to sell
installment payment plan section are testimony to
the same. Is Raheja now saying that they will only
ask installments in a construction linked manner?
It seems Rahejas are under pressure to get their

last time we spoke on vedanta, they had confirmed
that herafter letters would be delayed till
development also matches. but then in other
project they were continuing same. possibly legal
notice have been served. and in case if they dont
mend their ways. more cases could come up. And in
the nutshell, even if they win the case, the image
gets damaged. | |

Jeetinder In response to my communication to
Rahejas expressing displeasure at the progress not
keeping pace with the collection of installments,
they have sent me a response which says that my
query has been forwarded to Mr. Raheja and Mr.
Sanjeev Roy (Head of Projects) and that Mr. Roy
has given a commitment that by beginning of
November there will be significant developments at
the site. They have also asked to refer to the
payment plan which specifies that construction
schedules shown are indicative and does not affect
the due date of installment and that the Company
may at its sole discretion may suspend the
installment collection if it feels that the
construction of the project is delayed beyond two
months. I would request other interested members
of the forum to keep up the pressure and also
write directly to company so that we get out
moneys worth. |

currently. Rahej have taken payment of 22 lacs
till date and they have not done any construction
till date. Another payment will be due in a month.
In case there is no signifcant in the construction
do you advice any of your investors to make any
further payments. |

no problems with developer, its intention or
financial condition. i have clarified there were
site issues which are resolved more or less.
problem definitely is that they are following a
time linked plan and development is not
proportionate. management should be replying on
that in a day or two, else we would take up that
issue post diwali and decide collectively.

Raheja if they are following time linked then it
starts from the agreement signing date which is
11th july in my case , and other buyers shall also
have a similar date in their agreement . then only
4th instalment is due now. not the 6th as they are
asking. If its construction linked then
foundations have not started yet. Their customer
service have no response. |

This time again its the same story with the Raheja
Builders. We got a mail on 23 September, saying
that theyll send the receipt for the 5th
installment within a week. But, again weve
received the demand letter and not the receipt, as
has been the case always. Also, when we called up
the customer care saying that u keep sending the
demand letter but dont send the receipt, the
response was You have to make the payment since
you have signed the contract. How professional is
this? Now again theyll spend another 2 days to
send the receipt, then if for some reasons like
holidays and all, the bank does not give the check
in time, theyll again ask for interest. |

| Query: Hi Jitu,
I want to book a flat in Raheja Builders upcoming
project, but Im not sure of their credibility. One
of my friends booked a flat in Vedaanta, and they
told me that for installment paid in July they
havent got the receipt, though theyve received the
demand letter for next payment. Also, they
received the demand letter on 11 Sep, but the
demand letter states that interest component has
to be paid because contract was signed on 12
April, and so 4 months were completed on 12 Aug.
Is it not the builders mistake if the demand
letters are not dispatched in time? How are people
expected to pay the next installment without
getting a receipt for the previous one, even after
a month? I do not stay in Delhi/NCR and would have
to tell my parents to co-ordinate on the payments
side, and I cannot expect them to keep calling the
builder for every small little issue. This might
be a one-off case but I feel a builder with so
many upcoming projects needs to be more
professional. I wanted to know your opinion on the
Builders credibility, so I can take a decision.

builders are processing bookings much more than
they did in life time. Administratively more or
less similar for all. As far as credibility is
concerned they have delivered projects in gurgaon
- residential as well as commercial. License recd
and allotment stage for all three projects
vedanta, navodya and atharva construction started
for first two. So no credibility issues really.
Pick up a resale in vedanta or consider
original/resale in uppal canary residency.

heared the area is not dveloped at all and is not
a nice place to go for. What is your openion? Do

normally and actively resell what has been booked
through us so that our investors are taken care
of. We are waiting for raheja to release the
transfer documents and procedure. Starting price
was 2375 psf. Ofcourse there was discount also to
our clients. Transfer fee is 50 psf. I think the
first asking price should not be less than 2475
psf except if you are a panic seller.

understand what do you gain by directly booking
from the developer. You dont get discount, service
part is limited. Those who booked through us got
discounts on bsp, constant support as regards
allotment, pmt deposits, bank funding and even for
resale. There is a transfer fee of Rs.50 psf. Also
if you sell through a broker a brokerage of around
1 percent i.e. Another Rs.25 psf is another cost.
So min Rs.75 psf is what you need to demand extra
to sell at par and for premiums it has to be even
more. | |

raheja transfer can take place only after
execution of agreement. That stage is underway. In
dlf discounts are less say 1 percent as dlf offers
only 2 percent to its brokers.

areas have to develop a fresh. Both have a
developed area within 5km radius. One is closer to
airport, delhi etc. Other is closer to exisiting
gurgaon. Though presently i would favour uppal
bcoz - first price advantage, better accessibility
on as is to where is basis, direct from developer,
lower investment and upfront.
